1. Duration of Holiday
1.1 The duration of your holiday is the number of
nights as stated on our confirmation, related to your requested
reservation.
1.2 The villa cannot be entered before 4:00 pm on
arrival date stated (check-in) and must be cleared before or at the
latest at 11:00 am on departure date (check-out) stated on contract.
1.3 Guest arriving outside of management company
business hours can collect the villa keys from a lock box outside of
"USA Vacation Homes" offices.
2. Booking Confirmation
2.1 By signing the booking form and renting our villa
you agree to accept these terms and conditions.
2.2 All bookings of the property are made between the
owner and the Signatory (see paragraph 2.4 below). When we have
received your booking form and deposit (or full payment for a late
booking), there will be a contract between us.
2.3 Should a reservation be made without a signed
booking form (e.g. a late availability by telephone) the verbal
agreement shall act as a contract between us, and these terms and
conditions shall be deemed to apply.
2.4 The person who signs the Booking Form will be
referred to as the Signatory. The Signatory must be over 18, and in
signing the booking form accepts these terms and conditions on
behalf of everyone in his or her party. All correspondence shall be
addressed to the Signatory and we shall have no responsibility to
communicate with anyone in the party other than the Signatory.
3. Payment
3.1 A deposit of 20% of the total cost of villa
rental is required at the time of booking.
3.2 We must receive the payment within 7 days from
the date of reservation to guarantee your booking (not including
Christmas Day, New Years day or Bank Holidays).
3.3 Credit Card Payments will be subject to a 2%
handling fee.
3.4 The Signatory shall be responsible for the
payment of all monies due under any booking made. The owner shall
not be responsible for issuing reminders that payments are due, but
will issue a receipt on payment.
3.5 The Signatory shall be responsible for the
payment of all monies due to us in connection with your Booking.
3.6 Security Deposit
a. All reservations are due to a security deposit of
US$ 500 per stay. The security deposit can be collected at the
management company offices on arrival or via a secure website prior
to the vacation.
b. If providing the deposit on arrival at the
management company, the Signatory will be asked to sign a Credit
Card slip. This will not be taken off Credit Card Holders' account,
unless damage to the property is reported by the cleaners to the
management company at he end of the rental term.
c. If the customer is not a credit card holder, a US$
500 cash deposit will be required by the management company, which
will be refunded within 30 days of departure after inspection of the
rented unit.
d. If customer arrives after the management company
business opening hours, he or she is to contact the offices the next
business day and fulfil his security deposit obligations.
3.7 Payment of Balance
a. The balance of the payment must reach us at least
8 weeks before your departure date. It is your responsibility to
make sure that payments reach us on time, no reminders will be sent.
b. If the balance is not paid 8 weeks before your
departure, we reserve the right to cancel your booking. However, as
failure to make payment by the due date would mean that you were in
breach of contract, you would still be responsible for the balance
of the payment in such circumstances.
3.8 Extra Costs
a. Local taxes are included in the quoted rental
price. Pre-arrival clean is included in our rates for a stay of at
least 5 days. Pre-arrival cleaning will be added for stays of 4 days
or shorter. No further cleaning will be charged unless the
accommodation has been left in an extreme condition.
b. Customers will only be charged for extras if
he/she explicitly requests the option(s).
c. Options are:
Pool Heating: GB£12 per day (minimum of 4 days) or GB£70 per week
Crib: GB£20 per week
High Chair: GB£20 per week
4. Changes to your Booking
4.1 If you want to make any changes to your original
booking, this technically constitutes a cancellation of your
original booking.
4.2 We will do our best to accommodate any requests,
which you might make, but we cannot make any guarantees, as the
change, which you request, may impact on other bookings.
4.3 All requests for changes must be submitted in
writing (FAX is acceptable). We cannot process any requests for
changes, until they are confirmed in writing.
5. Changes or Cancellation By Us
5.1 As with any other holiday, there may be
circumstances completely beyond our control and contemplation, in
which the property might not be available for booking. Examples of
these circumstances include (but are not limited to) destruction of
or severe damage to the property. Such circumstances are referred to
as "Force Majeure".
5.2 In the event of Force Majeure, we will do our
best to make alternative arrangements for you where possible. If we
can't, or if the alternative arrangements are unacceptable to you,
then we will refund all monies paid. This will be the full extent of
our liability to you in such circumstances, and we shall not be
responsible for any other costs connected with any such
cancellation, however arising.
6. Cancellation By You
6.1 Apart from cancellation, which arises out of
non-payment, any other cancellation must be confirmed in writing by
the Signatory, and will not be effective until we receive such
written confirmation.
6.2 A charge will be made for cancellation. The
amount of the charge will depend upon the time of cancellation.
a. More than 56 days before your departure date, the
amount of the cancellation charge will be your deposit only.
b. Between 28 - 56 days before your departure date,
the cancellation charge will be 50% of the rental.
c. Less than 28 days before your departure date, the
cancellation will be 100% of the rental.
7. Insurance
7.1 It is a condition of this booking that all
members of the party are covered by travel insurance which carries
adequate protection against delays and cancellation, and has
adequate medical insurance for the USA, and your luggage and
personal belongings.
8. Liability
8.1 We cannot accept any liability for any loss of
rental time or delays which you may incur due to travel problems.
8.2 We cannot accept any liability for any injury
sustained by any clients or their visitors to either the property or
the swimming pool, howsoever arising.
8.3 We cannot accept any liability for any loss or
damage to any property, which is brought to the premises.
8.4 We cannot accept any liability for any loss,
damage or delay arising out of circumstances which constitute Force
Majeure, including but not limited to, flight delays and/or flight
cancellations, weather conditions, industrial disputes, terrorist
activities, and all events of a similar nature which are outside our
control.
9. Complaints
9.1 If you have any cause for complaint during your
stay, please contact the management company.
9.2 If in complaint is not rectified at first
instance, please confirm it in writing to the management company and
copy it to us on your return.

10. Party Size
10.1 The maximum number of people is 8 and is the
number allowed by Fire regulations. Parties larger than this would
void any protection you have under our insurance.
11. Code of Conduct
11.1 Four Corners Estate is a residential community.
Nothing should interfere with the continued quiet enjoyment of other
holidaymakers and residents. Please do not play loud music, or do
anything else which is likely to inconvenience your (and our)
neighbours after 22.30 or before 07.30.
11.2 In the event that anyone in your party behaves
in a way which our management company believes is likely to cause
danger, distress or annoyance to anyone else on Four Corners
Estates, or damage any property in any way, we reserve the right to
terminate your let immediately and forthwith.
11.3 Should it become necessary for us to terminate
your property let in accordance with clause 11.2 above, then any
responsibility which we have for your arrangements will cease
immediately and forthwith.
11.4 Please treat our villa with respect, and leave
it clean.
12. Pets
12.1 Sorry no pets are allowed.
13. Purpose of This Agreement
13.1 The villa is let for holiday purposes only.
13.2 It is not the intention of the parties to enter
into any form of furnished letting arrangement. Nothing in this
Agreement shall be interpreted as giving rise to any such form of
agreement.
14. Owner Access
14.1 The owner, or their agent(s), shall be allowed
access at any reasonable time during your stay.
15. Rights of Owner
15.1 We reserve the right to vary the rates
advertised in our brochure / website at any time.
15.2 We reserve the right to vary the terms and
conditions of rental at any time.
15.3 We reserve the right to decline to rent to any
person or party without being obliged to give reason.
16. No Smoking
16.1 Smoking is strictly prohibited on the premises.
16.2 If condition 16.1 is not adhered to then the
cost of deodorising the premises will be deducted from your security
deposit.
By renting the vacation home, customer
acknowledges and agrees to all our terms and conditions
